Wrongful
Death Claims
In Massachusetts, a decedent's spouse, children or next of kin are
entitled to recover money damages from a person who, by his negligence
or wilful, wanton, or reckless conduct causes the death of another.
Recoverable damages include the fair monetary value of the decedent
to the persons entitled to receive the compensation.
This
includes compensation for the loss of the reasonably expected net
income, services, protection, care, assistance, society, companionship,
comfort, guidance, counsel and advice of the decedent. It also includes
the reasonable funeral and burial expenses of the decedent, damages
for conscious pain and suffering and punitive damages to punish
the wrongdoer.
