Workers' Compensation Claims

Employers are required by law to carry workers' compensation insurance. Workers' compensation provides benefits to workers who are injured on the job. Generally, the Workers' Compensation Act is a wage replacement law which pays the injured worker a percentage of his or her average weekly wage. In addition, workers' compensation pays the reasonable and necessary medical costs related to the injury. If the injury happens during the course of employment, the worker is entitled to workers' compensation benefits regardless of who is at fault for the injury. The worker is not allowed to sue the employer.
