FEES & MEDIATION PROCEDURES

MEDIATION FEES

The cost of the mediation shall be divided equally among the parties unless otherwise agreed to by the parties.

Half-Day Mediation Session:    $1,800.00 (divided equally among the parties)
Full Day Mediation Session:     $3,200.00 (divided equally among the parties)


Unless otherwise stated, the fee for the mediation session is inclusive of all mediation services including: preparation, research, consultations and correspondence.  Travel time and expenses are not charged unless expressly stated and agreed to by the parties.

RESERVATION OF DATES & PAYMENT

Payment in full is due upon confirmation of reserved dates. Confirmation of the date, time and place of the mediation shall be mailed or emailed to the parties at least fourteen (14) days in advance of the mediation session.

CANCELLATION & RESCHEDULING

Fees will be refunded in full if the matter is cancelled and written notice is received at least thirty (30) days in advance of the scheduled mediation date.  A $100.00 administrative fee is charged for cases cancelled within thirty (30) days of the scheduled mediation date. There is no administrative fee for rescheduling a mediation.

MEDIATION BRIEFS

Mediation briefs are very helpful in preparation for the mediation session. If possible, mediation briefs should be sent by email to cmc@campomediation.com. Otherwise, please send to the mailing address below or fax to 617-977-8787 no later than ten (10) days before the scheduled mediation date.  Briefs may be exchanged or kept confidential at counsel's option.

Briefs to the mediator should be limited to ten (10) pages and include: a brief summary of relevant facts, an explanation of liability, a breakdown of damages, the history of any settlement discussions, and any information you believe the mediator should know in order to better understand the case from your perspective. If the parties wish the mediator to review extended documentation, adequate time for review should be arranged with the mediator. 

Please state on the face sheet of the brief whether or not it is confidential.

MEDIATION SETTLEMENT AUTHORITY

In order to engage in effective and worthwhile settlement negotiations, it is extremely important that the parties in attendance have settlement authority. Please advise the mediator prior to the mediation if this might pose a problem.

MEDIATION & CONFIDENTIALITY AGREEMENT

The parties to the dispute and/or their attorneys or authorized representatives shall enter into a written mediation agreement prior to the commencement of the mediation.

PARTICIPANTS

Only the parties and their representatives may attend mediation sessions. No one else may attend mediation sessions without the express permission of the parties and the consent of the mediator.

VIDEO CONFERENCING

Video conferencing is available at an additional cost and must be scheduled at least ten (10) business days before the mediation session.
