Site Accidents
A
worker injured on a construction site is entitled to recover money
damages from a third party, other than his employer, if the third
party contributed to or caused the injury. For example, an employee
of a subcontractor injured on a construction site would be entitled
to compensation from the general contractor or some other third
party who contributed to his or her injuries by causing or allowing
unsafe work conditions to exist.
For
Example: A laborer was working for a demolition company that
was a sub-contractor on a construction site. He fell more than thirty
feet and sustained a serious back injury. Our investigation determined
that the general contractor had not provided proper safety lines
and tie-off locations, in violation of federal and state safety
regulations. We filed a third party lawsuit against the general
contractor and settled the lawsuit for $850,000.00.
