No Fault
Automobile Insurance Benefits
Massachusetts is a so-called "no fault" automobile insurance
state, which means you're entitled to certain limited insurance
benefits regardless of who caused the accident. These benefits are
called personal injury protection benefits, or "PIP" benefits,
for short.
Generally,
an eligible person may receive up to $8,000 in personal injury protection
benefits. The benefits you are entitled to are a combination of
reasonable and necessary medical expenses, lost wages and so-called
replacement services.
Usually,
PIP benefits are paid by the insurance company that insures the
automobile in which the injured person was riding. If the injured
person was a pedestrian, then the insurance company that insures
the vehicle that struck the pedestrian pays these benefits.
Remember,
eligible persons are entitled to these benefits regardless of who
was at fault. However, you would be entitled to additional compensation
if the other person was at fault for your injuries and you meet
certain conditions. Click here to see what else you may be entitled
to recover.
Note:
These are general statements of the law and the law can change.
there are very specific rules on who is entitled to what type of
automobile insurance benefits. you should consult with an experienced
attorney regarding your specific case.
